Safety & Compliance FAQs:
Q: How many times do I have to inspect eye wash stations?
A: According to the RESAP program they must be inspected and documented on a monthly basis.
Q: How do I complete the online accident reporting portion of the new regulations?
A: Begin by going to www.OSHA.Gov A search can easily be done to direct you to the information about the recording rules. The link from their main page will not be operational until February 2017.
Q: How often is first-aid training required?
A: First-aid training is required by OSHA every two years. You can dig into the regulations and see where, in certain high hazard industries, it is recommended that it be done annually; however, it is not a requirement. It is important to look at the training group as well to determine the frequency of the training. The cards handed out may give an expiration date in less than the two years, depending on if the materials used were Red Cross or if the American Heart Association provided the information. Please remember it is your choice how often you want to train more than every two years.
Q: If I have less than 20 employees, do I have to report annually to OSHA online?
A: No. The new reporting rule states that only employers with more than 20 employees must record this information on their website. This is different in the fact that the employee number when recording must take place is 10 within the other rules.
Q: What is the digger derrick exemption from the crane standard?
A: The exemption is only for derricks that normally have an attached auger that is involved in regular utility work. (See crane standard final rule.)
Q: When must my employees be trained by to be compliant with the crane standard?
A: Compliance date is November 10, 2017.
Q: How often will I need to recertify as a crane operator?
A: Every five years.
Q: Does MoDOT require us to have hard hats that are orange or yellow when flagging?
A: The PPE required by MoDOT to flag does include a florescent orange or yellow hard hat. It is acceptable for the flagger to have a different colored hard hat with a cover of the correct color over it though. This is covered in the MUTCD and has been discussed in many different trainings provided by MoDOT.
Q: What is at stake if I choose to not follow MoDOT rules?
A: They can deny work permits and not allow you to work on their property.
Q: What is the entry-level driver rule compliance date?
A: February 7, 2020.
Q: Will all licensed drivers before the compliance date be grandfathered in?
A: Yes - only required for new drivers after February 7, 2020.
Q: Do all of our commercial vehicles have to have a DOT number?
A: No. They do if they will be operative out of state only. We are considered private carriers and are exempt from the MO requirements.
Q: What is the legal blood alcohol concentration amount for a CDL operator while in a commercial vehicle?
A: The legal concentration amount must not be any higher than 0.04 if they are operating a commercial vehicle. All other vehicles will be at the 0.08 level.
Q: What is the tier II reporting thresholds for gasoline and diesel fuel?
A: Tier II reporting must be done if at anytime you have 1,600 gallons of gasoline or 1,360 gallons of diesel fuel on site (10,000 lbs.)
